TSSA The Silent Killer Promotion 2017

OFFICIAL CONTEST RULES ("RULES")

Technical Standards & Safety Authority ("TSSA") is the Sponsor of The Silent Killer Promotion 2017 (the "Contest"). The Contest is subject to these Official Contest Rules (the "Rules").

The Contest starts Monday, March 13th , 2017 at 8:00 AM (the "Contest Start Date") and continues until Thursday, May 18th , 2017 at 11:59 PM (the "Contest Closing Date"; the duration being the "Contest Duration". All contest times are local Ontario time.

1. How to Enter

1.1 No purchase necessary. Maximum one (1) entry per valid e-mail address. Enter the contest by completing the on-line entry form. All entries must be received prior to the Contest Closing Date to be eligible for a chance to win a Prize.

1.2 To submit entries, visit the website www.TheSilentKiller.ca/Kidde and complete all of the mandatory fields in the entry form (e.g., first name, last name and valid email address). Upon completion, click "SUBMIT" and you will automatically be entered into the Contest.

1.3 The odds of winning depend upon the total number of eligible entries received prior to the Contest Closing Date.

2. Prizes

2.1 There are 100 Prizes to be won, valued at approximately $45.00 each:

• Kidde 10-Year Worry-Free Digital Carbon Monoxide Alarm

2.2 All costs associated with using or claiming a prize are the sole responsibility of the prize winner.

3. Contest Draw

3.1 Ten (10) random draws, conducted by a TSSA representative or agent, from all eligible entries will occur weekly beginning March 20th, 2017 and ending on May 19th, 2017. The contestant associated with the weekly winning entry (the "Provisional Winner") will be notified via email.

3.2 In order to be awarded a prize, the Sponsor must make positive contact with a Provisional Winner. Positive contact is where the Sponsor receives a reply e-mail directly from the Provisional Winner such that the Sponsor can make arrangements for the pick-up or delivery of the prize.

3.3 The Sponsor will attempt to make positive contact with the Provisional Winner at the e-mail address provided in the Provisional Winner's electronic entry.

3.4 The Sponsor will make at least two (2) attempts to contact each Provisional Winner: once per day on two consecutive business days, commencing on or about March 20th, 2017. No communication will be entered into except with the Provisional Winner.

3.5 If the Sponsor is unable to make positive contact with a Provisional Winner by 5:00 PM on the second business day after the Sponsor first attempt to make positive contact with the provisional prize winner, the Provisional Winner will no longer be eligible to be awarded a prize and another entrant will be drawn as the Provisional Winner, and the process of contacting the new Provisional Winner will be repeated until the prize is awarded. If a Provisional Winner does not claim its prize within seven days of positive contact, the Sponsor reserves the right to draw another Provisional Winner.

3.6 For a Provisional Winner who is a minor, the contestant's parent or legal guardian must sign and return the Release & Indemnity form on behalf of the minor in order for the minor to remain eligible to win a prize.

4. Who Can Enter

4.1 Except as noted below, the Contest is open to all legal residents of Ontario only, both over the age of majority and minors (i.e., persons under the age of 18).

4.2 Contestants who are under the age of thirteen (13) must have permission from a parent or legal guardian to enter the contest. Prizes won by contestants under the age of 13 will be awarded to a parent or legal guardian of on behalf of the minor.

4.3 The following persons ("Promotion Entities") are not eligible to participate in the Contest:

(a) directors, officers, employees and agents of the Sponsor;

(b) Any person involved in the development or operation of the Contest or the awarding of prizes; or

(c) the spouse or common-law partner, children or other person domiciled with any of the above persons.

5. Conditions of Entry

Compliance with Rules

5.1 Contestants must comply with these Rules and all eligibility requirements. Contestants found to have not complied with the Rules or eligibility requirements are subject to disqualification.

5.2 Contestants agree to be bound by the decisions of the Sponsor, made in its sole discretion, which shall be final and binding in all matters relating to the Contest.

Prohibited uses

5.3 Maximum one (1) contestant per valid e-mail address. Entries generated by script, macro, robotic, programming or any other automated means are prohibited and will be disqualified.

5.4 Contest Participants shall not deliberately damage any website or undermine the legitimate operation of the Contest.

5.5 Contestants determined by the Sponsor to violate any part of this section will be disqualified and all connected player registrations will be cancelled, and will forfeit any prizes awarded to the contestant. In addition, the Sponsor reserves the right to criminally prosecute and/or seek civil remedies (including damages and injunctive relief) against such contestants.

Proof of eligibility

5.6 The Sponsor shall have the right to require proof of identity and/or eligibility to participate in the Contest at any time from any contestant. Failure to provide such proof may result in disqualification.

5.7 All personal and other information requested by and supplied to the Sponsor must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right in its sole discretion to disqualify any contestant who provides the Sponsor with untruthful, incomplete, inaccurate or misleading personal details and/or information.

Dispute over identity

5.8 If a dispute arises regarding who submitted a contestant registration and promo code, the registration will be deemed to be submitted by the authorized account holder of the e-mail address provided at time of registration. Authorized account holder is defined as the natural person who is assigned to an e-mail address by an internet service provider, online service provider, cellular phone provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Disclaimers

5.9 The Sponsor is not responsible for late, lost, damaged, misdirected, mutilated, garbled, illegible or incomplete entries. Proof of transmission (screenshots or captures of game play etc.) and/or mailing does not constitute proof of entry submission.

5.10 Contestants and prize winners assume liability for any injuries caused, or claimed to be caused by participating in the Contest or by the acceptance, possession, or use of any prize awarded, including but not limited to claims or damages for personal injury and property damage.

5.11 By participating in this Contest, each contestant agrees to release, discharge, and forever hold harmless the Sponsor, Promotion Entities, their respective affiliates, subsidiaries, advertising and promotional agencies, and their respective directors, officers, employees and assigns from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the operation of this Contest, the contestant’s participation or attempted participation in the Contest, compliance or non-compliance with these Rules and acceptance, use or misuse of any prize.

5.12 The Sponsor and the Promotion Entities do not warrant that access to or use of the service will be uninterrupted. The Sponsor and the Promotion Entities are not responsible for any problems that may arise, including, but not limited to,

(a) lost, interrupted, inaccessible or unavailable connections to networks, servers, satellites, internet service providers, websites or other problems arising in connection with or over the course of the Contest;

(b) communication failures, jumbled, scrambled, delayed or misdirected communications, computer, telephone, hardware or software malfunctions, failures or difficulties;

(c) printing, clerical, typographical or other errors in these Rules, the Contest website or in the announcement of any prize or prize notification communication;

(d) errors of any kind in connection with the Contest, whether human, mechanical, clerical, electronic, or technical in nature;

(e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Contest; or

(f) damage to a contestant's system occasioned by participation in the Contest or downloading any information necessary to participate in the Contest.

Contest Modification

5.13 The Sponsor reserves the right to suspend, cancel or modify the Contest at any time without giving prior notice, if fraud, technical difficulties (including network or hardware failure, viruses, bugs, errors in programming), or any other causes beyond the control of Sponsor undermine the administration, security, integrity or proper play of the Contest.

Governing Law

5.14 Any issue or dispute arising from the Contest or these Rules shall be governed by and construed in accordance with the laws of the Province of Ontario without regard to Ontario conflicts of law principles. Contestants consent to the jurisdiction and venue of the Province of Ontario.

Severability and Amendment

5.15 The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

5.16 These Rules may only be altered by official sanction of TSSA; the Sponsor's employees are not authorized to waive, modify or amend any provision or provisions of these Rules without TSSA approval.

Intellectual Property

5.17 Any ideas or intellectual property submitted by Contest participants become the property of the Sponsor without payment of any compensation.

6. Personal Information and Privacy

6.1 By entering the Contest, contestants consent to the use of their name, address (city and province only) and likeness (if provided) without compensation, worldwide and in perpetuity, in any and all forms of media, in any publicity or advertising carried out by the Sponsor relating to the Contest.

6.2 The Sponsor will not sell, share or otherwise disclose personal information of Contest participants with third parties, other than to third parties engaged by Sponsor to fulfill the above purposes or as permitted or required by law. By entering the Contest, participants consent to the manner of collection, use and disclosure of personal information as set out in the Sponsor's privacy policies, which are available at http://www.tssa.org/regulated/about/PrivacyPolicy.aspx.
